HISTORICAL NOTE

These records represent part of a larger collection of original and microfilmed documents from all 100 North Carolina counties, which have been deposited in the Local Records Section of the North Carolina Division of Archives and History in Raleigh.

The Court Records originated from the primary administrative and judicial body of the N.C. county the County Court of Pleas and Quarter Sessions. Established in the Fundamental Constitutions of 1669, the County Court met quarterly to exercise limited civil and criminal jurisdiction and to administer affairs such as the levying of taxes, the recordings of property conveyances, and the erection of public buildings. The official records of these sessions are the Minutes, kept by the Clerk of the Court. In 1868, the County Court of Pleas and Quarter Sessions was abolished. The Board of County Commissioners assumed the Court's administrative functions; the Superior Court assumed the judicial functions.

The Estates Records originated also from the office of the County Court of Pleas and Quarter Sessions before 1868, and after, from the office of the Clerk of Superior Court. They relate to the probate jurisdiction of the office, involving the supervision and control of fiduciary relationships. These records contain information on the administration of estates and include original bonds, accounts, and settlements of estates, as well as detailed inventories of the property of deceased persons. The records were filed with the office by the administrators and executors of estates.

The Land Records originated from the office of the Register of Deeds, whose duty was to record all actions acknowledged by the County Court of Pleas and Quarter Sessions. His primary responsibility involved registration of real estate. The Record of Deeds includes the permanent record of real estate conveyances, encumbrances, mortgage deeds, deeds of trust, bills of sale, crop liens, and chattel mortgages. The largest group of records is the real estate conveyances, the official document relating to the transfer of title. Although the real estate conveyances were at first recorded in the Record of Deeds together with other documents, it became common practice by the end of the nineteenth century to file the conveyances in separate volumes, because of their bulk and frequent use.

The Tax Records were kept by the County Court of Pleas and Quarter Sessions until 1868, and by the clerk of Superior Court thereafter. The primary tax record is the Tax List, an annual compilation of taxpayers and taxables. The lists are arranged by township, with taxpayers filed alphabetically therein, and were prepared from the individual tax scrolls of each tax collector.
